This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name 16tb.club (the "Website"), including the related mobile site and mobile application (hereinafter collectively referred to as the "Platform").

1. Introduction and Agreement

1.1. Platform Ownership: The Platform is owned and operated by 16TB DataCore Technologies, a company incorporated under the Companies Act, 1956, with its registered office at Casa Rio, Palava City, Dombivli (E), Thane, Maharashtra, India - 421204 (hereinafter referred to as the "Platform Owner", "we", "us", or "our").

1.2. Binding Agreement: Your use of the Platform and its related services and tools are governed by the following terms and conditions ("Terms of Use"). These Terms of Use, including all applicable policies which are incorporated herein by reference, constitute a legally binding contract between you (the "User") and the Platform Owner. By accessing, browsing, or transacting on the Platform, you acknowledge your acceptance of these terms and agree to be bound by them.

1.3. User Definition: For the purpose of these Terms of Use, wherever the context so requires, "You", "Your", or "User" shall mean any natural or legal person who has agreed to become a user or buyer on the Platform.

1.4. Modifications to Terms: We reserve the right to modify these Terms of Use at any time without prior notice. It is your responsibility to periodically review these Terms of Use to stay informed of any updates. Your continued use of the Platform following any changes will constitute your acceptance of such changes.

ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORM INDICATES YOUR UNCONDITIONAL AGREEMENT TO ALL THE TERMS AND CONDITIONS HEREIN. PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

2. User Obligations and Conduct

2.1. Account Accuracy: To access and use our services ("Services"), you agree to provide true, accurate, and complete information during and after registration. You shall be solely responsible for all activities conducted through your registered account.

2.2. Lawful Use: You agree not to use the Platform or its Services for any purpose that is unlawful, illegal, fraudulent, or prohibited by these Terms or by any applicable Indian or local laws.

2.3. Service Payments: You agree to pay the Platform Owner all charges associated with availing the Services as described on the Platform.

3. Disclaimers, Warranties, and Limitation of Liability

3.1. No Warranty: Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered on this Platform or through the Services for any specific purpose. You acknowledge that such information may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

3.2. Use at Own Risk: Your use of our Services and the Platform is solely and entirely at your own risk and discretion, for which we shall not be liable. It is your responsibility to independently assess and ensure that the Services meet your specific requirements.

3.3. Third-Party Links: The Platform may contain links to other third-party websites. These links are provided for your convenience to provide further information. On accessing these links, you will be governed by the terms of use and privacy policies of such third-party websites. We hold no responsibility for the content or practices of these linked websites.

4. Intellectual Property

4.1. Ownership: The contents of the Platform and the Services, including but not limited to the design, layout, look, graphics, and text, are proprietary to us or are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents.

4.2. Unauthorized Use: Unauthorized use of the Platform, its content, or the Services may give rise to a claim for damages and/or be a criminal offense under applicable laws.

5. Indemnification and Legal Terms

5.1. Indemnity: You shall indemnify and hold harmless the Platform Owner, its affiliates, group companies, and their respective officers, directors, agents, and employees from any claim, demand, or actions (including reasonable attorneys' fees) made by any third party or penalty imposed due to or arising out of your breach of these Terms of Use, our Privacy Policy, your violation of any law, or your infringement of the rights (including intellectual property rights) of a third party.

5.2. Force Majeure: The parties shall not be liable for any failure to perform an obligation under these Terms if such performance is prevented or delayed by a force majeure event, including but not limited to acts of God, war, civil unrest, or government action.

6. Governing Law and Dispute Resolution

6.1. Governing Law: These Terms of Use shall be governed by and construed in accordance with the laws of India.

6.2. Arbitration and Jurisdiction: Any dispute, controversy, or claim arising out of these Terms shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Thane, Maharashtra. The courts in Thane, Maharashtra shall have exclusive jurisdiction only for the purposes of enforcing the arbitration award or granting interim relief, and not for the original trial of the dispute.

8. Domain Name Services

8.1. Applicability: In addition to these Terms of Use, the purchase, registration, renewal, and transfer of domain names ("Domain Services") are subject to the terms, conditions, and policies of the respective Top Level Domain (TLD) registries and the Internet Corporation for Assigned Names and Numbers (ICANN). By purchasing a domain through the Platform, you agree to be bound by these third-party terms.

8.2. Registration and Ownership: You represent that the registration of any domain name is not for any unlawful purpose and does not infringe upon the intellectual property rights of any third party. While you will be listed as the registrant, you acknowledge that the domain registration is provisional upon the successful clearance of applicable fees.

8.3. Payment and Suspension Rights:

  • Payment Due: All fees regarding the registration or renewal of domains must be paid in full in advance or within the specific payment window provided by the Platform.

  • Suspension for Non-Payment: We reserve the absolute right to suspend, park, redirect, or cancel any domain name registered through our Platform if you have any outstanding payments, chargebacks, or billing disputes with 16TB DataCore Technologies, regardless of whether the payment due relates specifically to that domain or other Services provided by us.

  • Restoration: We are not obligated to reactivate a suspended domain until all dues, including any applicable late fees or restoration fees, are paid in full. We shall not be liable for any loss of traffic, data, or business reputation resulting from such suspension.

8.4. Renewals: It is your sole responsibility to ensure that your domain name is renewed prior to its expiration date. While we may send reminders, we are not liable for the loss of a domain name due to your failure to renew or pay the renewal fees on time.

8.5. Domain Disputes and Mandatory Arbitration

  • Third-Party Disputes: You agree to be bound by the Uniform Domain Name Dispute Resolution Policy (UDRP) or any similar policy adopted by the domain registry. You acknowledge that 16TB DataCore Technologies is not a party to any dispute between you and a third party regarding domain registration or trademark infringement. Pursuant to Section 5 (Indemnification), you agree to fully indemnify and hold us harmless from any participation in such disputes.

  • Waiver of Court Proceedings: To the fullest extent permitted by law, you agree to waive your right to pursue any claim, dispute, or proceeding against the Platform Owner in a court of law. Any dispute arising out of or relating to these Domain Services that cannot be resolved amicably shall be referred to sole and binding arbitration, effectively barring the initiation of litigation in civil courts. The Platform Owner shall act solely in accordance with the decision of the appointed arbitrator or the specific Registry/ICANN ruling.
